What this document is
An Answer is your written reply to the lawsuit. It goes through the claims the company made about you, one at a time, and says whether each one is true, not true, or something you cannot confirm. It also lists the legal protections you want to use, which are called defenses.
You probably need this if
- You were handed court papers, or they were left at your home or mailed to you
- The papers are called a Summons and a Complaint
- You have not filed anything with the court yet
- Your deadline has not passed, or only just passed
Why it matters
If you file nothing, the company wins automatically. That is called a default judgment, and it can lead to money being taken straight out of your paycheck or your bank account. Filing an Answer stops that from happening and forces them to actually prove the debt is yours.
Timing
Most courts give you 14 to 30 days from the day you were served. The exact deadline is printed on your Summons, so check it today.
