Terms of Service

The short version

CaseDefender provides fill-in-the-blank forms and general legal information. It is not a law firm, does not act as your attorney, and does not provide legal advice. No attorney-client relationship or privilege is created.

1. What CaseDefender is

CaseDefender is an online provider of legal fill-in-the-blank forms and general legal information. You supply the information about your situation, you decide how to answer each question, and the service assembles your answers into a formatted document that you review, sign, and file yourself.

CaseDefender is not a law firm. It does not act as your attorney. It is not affiliated with any law firm. It does not provide legal advice, legal opinions, or legal representation, and it does not tell you what you should do in your case.

General legal information explains how a process generally works. Legal advice applies the law to your specific situation and recommends a course of action. CaseDefender provides the first and never the second.

2. No attorney-client relationship

Using CaseDefender does not create an attorney-client relationship between you and CaseDefender or anyone associated with it, and it does not create any attorney-client privilege.

Information you enter into CaseDefender is not privileged or confidential in the way communications with your own lawyer would be.

If you want advice about your specific situation, consult an attorney licensed in your state. Your state bar association maintains a referral directory.

3. You are representing yourself

If you use CaseDefender, you are acting as your own representative. Any document you produce is your own document and your own filing.

You are solely responsible and liable for every legal decision you make, including which document to file, how to answer each question, which defenses to raise, and when to file.

You must read every document in full before you sign it. Court documents are frequently signed under penalty of perjury, so you are responsible for the truth and accuracy of everything in them.

You are responsible for confirming that your document complies with the rules of your particular court, and for filing and serving it within the deadlines that apply to your case.

CaseDefender does not review your documents for legal sufficiency, does not verify your deadlines, and does not file or serve anything on your behalf.

4. No guarantee of any outcome

CaseDefender cannot and does not guarantee any result. No form, course, or tool offered here promises that a case will be dismissed, reduced, settled, delayed, or won.

CaseDefender is not responsible for the outcome of your case, for any judgment entered against you, for any deadline you miss, or for any document a court rejects.

Law and court procedure vary between states, between courts within a state, and over time. A document that is acceptable in one court may not be acceptable in another.

5. No warranty

The service is provided on an as-is and as-available basis, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

CaseDefender makes no warranty that the information provided is current, complete, or accurate, or that any document produced will be valid, enforceable, or accepted in every court.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

6. Limitation of liability

To the fullest extent permitted by law, CaseDefender is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of your use of the service.

To the fullest extent permitted by law, total liability for any claim is limited to the greater of the amount you paid for the service or one hundred dollars.

Nothing in this section limits liability for fraud, gross negligence, or intentional misconduct, or any liability that cannot be limited by law.

7. Documents can be generated once

Each document product allows you to generate that document one time. Review your information carefully before you download, because what you enter is what appears in the finished document.

If something goes wrong that is not your fault, contact support and we will reset it for you.

8. Purchases, refunds, and access

Products are sold as one-time purchases. The membership is a recurring monthly subscription that you may cancel at any time; access ends when the subscription ends.

Refunds do not cover court filing fees, government fees, or amounts paid to third parties. Those are paid to the court or to that third party, not to CaseDefender.

Payments are processed by Stripe. CaseDefender does not see or store your card details.

Access to what you purchase is tied to the email address used at checkout.

9. Your account and your data

We collect as little information as we can. We do not ask for your Social Security number, your date of birth, or full account numbers.

Case information you enter is deleted automatically 18 months after you last use it, and you can delete it yourself at any time from your account page.

10. Acceptable use

Do not use CaseDefender to produce a document containing any statement you know to be untrue.

Do not resell, redistribute, republish, or share the courses, forms, templates, or documents you obtain here.

Do not use the service to harass anyone or for any unlawful purpose.

11. Indemnification

You agree to defend, indemnify, and hold CaseDefender harmless from any claim, loss, or expense arising out of your use of the service, the documents you produce, the information you provide, or your conduct in your case.

12. Dispute resolution

Any dispute arising out of these terms or your use of the service will be resolved by binding individual arbitration in Arizona, rather than in court, except that either party may bring a claim in small claims court.

You and CaseDefender each waive the right to participate in a class action or class-wide arbitration.

These terms are governed by the law of the State of Arizona.

Some jurisdictions restrict these provisions, and where that is so, this section applies only to the extent permitted.

13. Changes and contact

We may update these terms. If we make a material change we will note it on this page.
